April 25, 2024, is Leadership Day. It is an annual event that gives building officials a chance to listen, learn and discuss items of importance to the building professional community and the municipalities we serve. The day and sessions will include several topics of interest which include:

1) Permit considerations – conditional, phased or partials and acceptance of items other than typical securities,
2) Breen v. Lake of Bays (Township): A Game-Changing Decision Upheld on Appeal That Widens Municipal Duty of Care in Ontario Building Code Administration.
Description:  Joint expert and legal presentation, Alison Orr and Marianne Brown of Orr Brown Consulting Engineers Ltd., and Paul E.F. Martin, a partner at Loopstra Nixon LLP, will discuss background, key information, interpretation of the decision and appeal, and the resulting impact to Municipalities in their enforcement of the Building Code Act and Regulations.
3) Alternate Solutions proposals – process and consideration, and
4) Provincial updates from MMAH and question period.

Breakfast 8-9am (Welcome remarks)

9-10:30am
In this session, audience members will be provided information on the considerations related to permits – conditional, phased or partials.  The acceptance of items other than cash for a performance guarantee.  Items to include the following: lines of credit, performance bonds, amenities agreements in which the costs for non-performance can include things from demolition or work completion with fees added to the property in a manner like property taxes.

Break 15 min

10:45am-12:15pm
In this session, Orr Brown will provide a presentation on the Breen Case. It will cover the decision, the key information, the impacts or fall out of the decision and any recent updates related to the matter.

Lunch 12:15-1:15pm

1:15-2:45pm
In this session, the audience will be provided information on Alternative Solution proposals – how to consider them and the process. The session will cover items like:  general requirements – how to review them by working backwards from most likely worse case or tragic situation that could occur. The session will also cover items like general policy considerations and protocols for Municipalities and building officials.

3-4:30pm
The final session of the day will be an update/presentation from the Province (MMAH). The provincial staff will provide an update on activities, the code and some time will be set aside for a question-and-answer period.

Alison Orr and Marianne Brown are Professional Engineers, designated Consulting Engineers, and Certified Building Code Officials, with Orr Brown Consulting Engineers Ltd., and are long standing members of the OBOA.

They graduated from McMaster University in the Civil Engineering department and immediately began their careers as building officials in 1994 with the City of Hamilton, first as building inspectors, then as building engineers. Alison left the City to join an engineering consulting firm, where she became involved in the investigation of collapses, failures, and the evaluation of buildings damaged by fire, impact, and weather events. She also provided opinions related to Standard of Care of municipal building officials. Marianne stayed with the City for 13 years until 2007, in the roles of Chief Building Engineer, and then finally Manager of Building Construction, after which she joined Alison in consulting. Marianne is presently the Alternate Chair of the Standing Committee for Housing and Small Buildings, which assesses code changes to Part 9 of the National Building Code of Canada.

Alison and Marianne formed Orr Brown Consulting Engineers Ltd. in 2011. Orr Brown provides expert opinions regarding simple and complex building code issues, and opinions regarding the standard of care of municipal building departments to assist in litigation. They have participated in insurance appraisals, arbitrations, mediations, coroner’s inquests, and trials.

You might run into them if your municipality is named in a lawsuit or if there is a damaged building in your municipality and they are assisting with emergency measures, scope of repair, and building code issues.

Paul E.F. Martin, Partner Loopstra Nixon LLP

Qualified in Ontario and California, Paul’s practice focuses upon the defence of municipalities, insurers, and corporations against an array of personal injury, property, land use and commercial disputes. Paul has handled both jury and judge-alone trials, as well as numerous contested motions and applications. He has appeared before all levels of Ontario Courts, as well as the Federal Court.

Paul specializes in the defence of Ontario Building Code lawsuits brought against municipalities, as well as by-law and OBC enforcement.

He is a frequent contributor to the Municipal Liability Risk Management Newsletter and speaks at client and public forums such as the Society of Public Insurance Administrators of Ontario, the Canadian Institute, and the Municipal Law Enforcement Association of Ontario.
